1. Introduction
Welcome to SAVI Photography, your trusted partner for capturing beautiful moments in Southern California. By engaging my services, you agree to the following terms and conditions. Please read them carefully.
2. Booking and Payment
2.1. Booking: To secure your session, a non-refundable deposit is required. The deposit amount will be specified in your invoice. Once paid, your date is reserved.
2.2. Payment: The remaining balance must be paid in full before the start of the session. We accept cash, checks, and major credit cards. Prices and payment details will be outlined in your invoice.
3. Cancellations and Rescheduling
3.1. Client Cancellation: In case of cancellation by the client, the deposit is non-refundable. If a cancellation is made within 72 hours of the scheduled session (or 2 weeks for weddings and event photography services), the full fee is still due.
3.2. Rescheduling: If you need to reschedule your session, please notify me at least 72 hours in advance for portraits, or two- weeks for weddings. I will do my best to accommodate your new date and time, but it is subject to my availability. More than one rescheduling request will incur a fee of 20% of the total cost of services per request.
3.3 Photographer Replacement/Cancellation: In the unlikely event that I am rendered unable to perform the photography services I have agreed upon, I will do my best to secure a trustworthy and equitable replacement who is available on the date and time of your session or event. If you are not reasonably satisfied with the replacement option(s) that I offer, you will have the opportunity to cancel my contract and be fully reimbursed any fees paid.
3.4 Inclement Weather. I will watch the weather forecast leading up to a portrait session. If the probability of precipitation is above 40% (during the day and time of shoot), I may contact you to reschedule. I also reserve the right to stop or offer to reschedule service due to other forms of inclement weather (like earthquakes or floods), in order to protect my safety and that of my equipment.
4. Copyright and Usage
4.1. Copyright: All images taken by SAVI Photography remain the sole property of SAVI Photography. We grant clients a limited, non-exclusive license to use the images for personal and non-commercial purposes.
4.2. Usage: You may not sell, distribute, or alter the images without mywritten consent. We reserve the right to use images for promotional purposes unless otherwise agreed upon.
4.3 Clients may request additional licensing rights which may be granted at the sole discretion of the photographer for an additional charge.
5. Client Cooperation
To ensure the best results, clients are responsible for the following:
5.1. Timeliness: Please arrive on time for your session, as lateness may result in reduced shooting time.
5.2. Preparation: Dress and prepare as discussed during the consultation. Any special requests should be communicated in advance.
5.3 Responsiveness: I will need to reach out to you at times with questions related to your session, your gallery, or your order. In order to serve you best and fulfill my responsibilities to you in a timely manner, it is important that you respond to such communication promptly.
6. Stylistic Expectations:
You can expect that your photos will be produced in a style that is consistent with the portfolio you see on my website, social media, and any client galleries to which I grant you access. I am able to incorporate many of your suggestions or requests, but a complete stylistic change is not possible.
7. Satisfaction Guarantee
We are committed to providing you with high-quality photography. If, for any reason, you are not satisfied with the results, please contact me immediately upon receiving your images/prints to discuss possible resolutions (but no later than 30 days).
8. Liability
While I take every precaution to ensure your safety during the session, SAVI Photography is not liable for any accidents, injuries, or damages that may occur during the session.
9. Force Majeure
In the event of unforeseen circumstances such as illness, acts of nature, or any other situation beyond my control, I will make reasonable efforts to reschedule your session or offer a full refund of fees paid, with the exception of the deposit, of which 50-100% will be returned on a case-by-case basis.
10. Failure to Deliver
Photographer shall not be held liable for delays in the delivery of such Work Product, or any Work Product undeliverable, due to technological malfunctions, service interruptions that are beyond the control of Photographer (including as a result of delays in receipt of instructions from Client) and for Work Product that fails to meet the specifications set out in Section 1.1 due to the actions of Client, vendors, attendees or participants at the photo shoot that are beyond the control of Photographer (e.g., camera flashes).
11. Privacy
We respect your privacy and do not sell, trade, or transfer your personal information to third parties. However, I may share your information with trusted partners who assist me in delivering my photography services, provided they adhere to strict confidentiality and data protection standards. In keeping with copyright law and the terms of your photography agreement, images may be shared as part of my portfolio.
12. Governing Law
These terms and conditions are governed by the laws of the state of California. Any disputes will be subject to the jurisdiction of the courts in California.
13. Changes to Terms
We reserve the right to update these terms and conditions at any time. Any changes will be effective immediately upon posting on my website. It is your responsibility to review these terms periodically.
